Graphic Terms and Conditions
STANDARD TERMS AND CONDITIONS
These Terms of Service are an agreement (the “Agreement”) between Akoi Media, P/L (“Akoiweb”) and you (“Client” or “you” or “your”). This Agreement states the terms and conditions of your use of the products and services (the “Services”) made available by Akoiweb and the Akoiweb.co.zw website. By using any of the Services, you agree to be bound by all of the terms and provisions of the Agreement. PAYMENTS
ALL graphic design work and printing shall be PAID in FULL in ADVANCE. Under no circumstances, will Akoiweb undertake a project without a FULL payment. Graphic design entails but is not limited to business cards, logos, flyers, brochures, calendars, adverts, t-shirts and more.
Process design order – Akoi Media P/L will only proceed upon written confirmation of the design quotation and the design fee paid in full. Approval of the quotation will constitute an agreement between Akoi Media P/L and the client.
Copyright – Zimbabwean Copyright Act (Chapter 26:1) 1967. Copyright will remain property of Akoi Media P/L until such time as a mutual agreement is in place. As part of Akoi Media P/L.’s terms of business, the copyright license is automatically released to the client on receipt of final payment for the commissioned work. Akoi Media P/L reserves the right to use all artwork produced for the purposes of promoting Akoi Media P/L in print, publication or website, unless explicitly denied to do so by client in writing. Bannershop reserves the right to reuse any cancelled artwork for additional or subsequent projects.
Nature or copy – Artwork, images and copy supplied by the client, will remain as the client’s responsibility and will be deemed as supplied to Akoi Media P/L with relevant authority for use. Akoi Media P/L will accept no responsibility for copyright issues regarding supplied artwork, images and copy. The client is responsible for supplying content free from infringement for all trademarks, service marks, and copyright.
Design fee – Fees quoted only for professional services do not include purchases of stock photos or artwork, products, printing or colour-matching. Additional expenses will be itemised on relevant invoices.
Payment and refunds – Design fees are to be paid in full before work commences. If the client wishes to cancel after quotation approval and payment, a $50 administration fee will be withheld from a full refund. If the design fee is less than $50, no refund will be given.
Artwork on USB – If client’s artwork is requested on USB, a fee of $30 applies. Courier/delivery cost will be payable by client.
Electronic proof – All proofs will be emailed to the client as a low resolution JPG file. Please be aware that all monitors display colour differently and the colour on a monitor could vary significantly from the final print. To ensure that the colour is correct, it is highly recommended that the client provides the Pantone colour and requests colour-matching service. Alternatively you may request a print sample. Additional cost applies for colour-matching and print sample services.
Approval – Whilst every care will be taken, no responsibility will be accepted by Akoi Media P/L for errors found after final approval by the client. Artwork approval must be emailed to Akoi Media P/L before we commence printing.
Archived design artwork – Akoi Media P/L archives design files for 18 months as a production process, however when final design files have been sent to the client it is the client’s responsibility to store and archive the documents safely for their own purposes or future use.
Errors and omissions – It is the client’s responsibility to check all proofs carefully for accuracy. The client’s e-mail of approval is acknowledgement that the proof has been evaluated and considered correct in every aspect. There will be no remedy from Akoi Media P/L for errors or omissions carried over from approved proof to final print.
Revisions – Each design package has a set number of revisions. If further revisions are required there may be additional charges applicable. The client will need to approve additional charges for extra design revisions and make payment in full prior to work commencing on the additional revisions.
Final Approval for Printed Products (printed by Akoi Media P/L) – Changes cannot be made once final approval has been given. Proof Approval triggers the production process which includes components that are fully automated. Any changes or cancellations after final approval will incur additional charges.
Final Approval for Custom Design only (no printed product) – Clients may make revisions after final approval has been given but may incur additional fees. See “revisions” section above.
